Service Terms and Conditions

INTRODUCTION 

These terms relate to testing and medical consultation services offered by Open House.  They may also cover any other services Open House offers or choses to offer. Details of current services are available from our website: www.openhouse.es Testing services include both in-clinic and remote provision.  

These terms provide information on the provision and delivery of the services described and your rights in accessing and terminating those services. If you think that there is a mistake in these terms, or if you have any questions, please contact us. 

PROVISION AND CONTACT 

The services listed herein is provided by Centro Medico Open House S.L.U. (herein, Open House or “we”), a Spanish company whose business address is C/ Atocha, 117, 1° izquierda, 28012, Madrid.  You can contact Open House at [email protected]  

Should we need to contact you we will do so through your preferred contact method which could be email, telephone number, or postal address you provided with your order.   

SERVICE 

Testing is provided through reliable and validated laboratory equipment with highly trained laboratory personnel; however, we are unable to provide any promises or guarantees about the accuracy of the results of your test. Medical Consultation is provided through experienced doctors who are qualified and accredited in Spain.  If you have any doubts with regard to your test(s) or results, we encourage you to seek advice, either through one of the Open House doctors or another qualified medical professional.  

It is important to read and understand the information which we have provided on our website when using our services.  Please see www.openhouse.es for guidance regarding service use, including when a test should be taken (as taking a test too early or too late could increase the likelihood of a false result).  Again, please consult an Open House doctor or another medical professional if in any doubt. 

CONTRACT 

Our acceptance of the order takes place when you receive a confirmatory email from Open House. This will list the service ordered and also contain an order number, which you should quote in any subsequent correspondence with us.   If we are unable to accept, or cancel, your order, we will inform you, and there will be no charge for the Service (or a refund of any charges you may have incurred). This could be for one of the following reasons: 

-the Service you have selected being temporarily or permanently stopped; 

-unforeseen limits on our resources; 

-identification of an error in the price or description of the Service; 

-technical problems or amendments to the Service; 

-Service updates to reflect changes in relevant laws or regulatory requirements; 

-Open House timelines being significantly longer than originally estimated. 

AMENDMENT  

Please inform us by email at [email protected] or telephone 914294959 for Madrid clinic services or 961644913 for Valencia clinic services if you wish to change your order. We will let you know if the change is possible and consequently, any related changes to price, delivery or any other factor affecting your order. You will then need to confirm whether you wish to proceed. If we cannot make the change or you do not wish to proceed with the amendments, you may want to end the contract (see section on CANCELLATION). 

CANCELLATION 

Your rights to amend or end the contract will depend on the product or service selected and whether is deficient or there is another problem.  Please also review the services and timeframes below, which may impact your eligibility for an amendment or refund. 

  1. A consultation and/or tests at one of our clinics.

You may cancel or reschedule an appointment at no additional charge if that change or cancellation is made up to 24 hours (one business day) before the scheduled booking time.  Please note that business hours are 10am – 8pm Monday – Friday.    If the appointment is cancelled within 24 hours (one business day) of the scheduled booking time, you may not be eligible for any refund or alternative appointment. 

PRICE AND PAYMENT 

The price for the Service (which includes the relevant delivery charge for the test kit) will be the price indicated on the order pages when you placed your order. We take reasonable care to ensure that the price of the Service advised to you is correct.  

 

It is always possible that, despite our best efforts, a Service we sell may be incorrectly priced.  Where the Service’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the Service’s correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order and depending on your instructions, may end the contract, and refund you any sums you have paid. 

 

We accept payment with Visa and Mastercard credit and debit cards. You must pay for the Service before we deliver it. 

LOSS AND DAMAGE 

If we fail to comply with these terms, Open House are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and attention. We are not responsible for any loss or damage that is not foreseeable.  

Open House does not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the Service. 

The Service is only for domestic and private use, and we are not liable for any business losses. 

Where the law permits us to do so, our liability is limited to the price of Services offered or delivered. 

TRANSFER OF RIGHTS 

Open House may transfer its rights and obligations under these terms to another organisation. We will let you know if we plan to do this. If you are unhappy with the transfer, you may contact us to end the contract within 2 days of notification and we will refund any payments that have made in advance for a Service which has not yet been provided. 

You may only transfer your rights or your obligations under these terms to another person if Open House agrees to this in writing. No other person shall have any rights to enforce any of its terms. 

 

Each paragraph of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect. 

If Open House does not insist immediately that you comply with these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not prevent us taking steps against you at a later date. 

These terms are governed by Spanish law and the court of Madrid.
